PLEASE DO YOUR HOMEWORK! You mentioned the fifty states, basically stating that this story takes place in the United States, so kindly read up on the laws before writing this! Claims for insanity only work for criminal cases, not tort cases. For tort cases, as long as there is intent, knowledge, and action is enough for conviction. The fact that she wrecked his car - insane or not - is enough for her to be convicted, in this case mostly as a fine. This fantasy world you created appears to be one where anyone can break the law. Also, if it's a criminal case, insanity needs to be verified and then they get stuck in an institution; they still to not get off scotch-free! Please fix this before continuing this story, and meanwhile, go talk to a law student or read up on tort cases!
